17:10 Item #35-2018 Consider the Naming of a New Private Road – Grouse Run Drive

As Addressing Coordinator, Chief Williams is bringing forth a recommendation to name a new private road as Grouse Run Drive. The private road has been built to access three building lots at 1189 Sawyer Road.

It is recommended the town council approve the new private road name at 1189 Sawyer Road as Grouse Run Drive as presented.

19:35 Item #36-2018 Request for a Zone Change to Business Zone A – 560 Shore Road

Cape Elizabeth Service Center located at 560 Shore Road is requesting consideration of a zone change to allow used car dealer plates.

Sec. 19-6-5. Business District A (BA)

B. Permitted Use
3. The following nonresidential uses:

h. Repair garage (Effective July 8, 2009) with a maximum of 3 used car dealer plates. Signage limited to one 8.5in x 11in sign on each car.

If the town council desires to further review the request it would be in order to refer to the planning board for review and recommendation.

The Fort Williams Park Committee has reviewed group use requests for 2018 and recommends the following uses:

CEHS Graduation Sunday, June 10, 2018
Family Fun Day Saturday, June 16, 2018 (Rain date Sunday, June 17, 2018)
Beach to Beacon Road Race July 31 – August 4, 2018

Making Strides Cancer Walk Sunday, October 14, 2018
Contingent upon payment of the ½ day Area Fee of $500.00

It is recommended the town council approve the Fort Williams Park 2018 group use requests as presented.

41:06 Item #38-2018 Review of Proposed Revisions to the Code of Ethics

At the December 14, 2017 town council workshop Town Attorney Thomas Leahy provided an overview of FOAA, conflicts of interest and bias. During the workshop it was a consensus of the town council to ask Mr. Leahy to review the Town Council Rules and Code of Ethics and suggest amendments to closer align the two documents relating to conflicts of interest.

Questions included - What rises to the level of an actual vote for a “disclosure” of information or an “appearance” of a conflict of interest? Currently is the council “over disclosing” relationships that are not financial conflicts of interest? Can a disclosure of information suffice without a vote?

The town council may adopt, edit, refer back to the town attorney for further review or refer to the
next regular meeting.
