The meeting will be preceded by the annual Town Council caucus at 6:15 p.m.   
The caucus is a caucus of the 2014 Council including councilors elected on November 5th.

01:12:11 Item# 132-2013          Draft Greenbelt Plan     
The town council will hold a workshop on November 13th on the draft greenbelt plan and it is proposed to set a public hearing on the plan for Monday, December 9, 2013 at 7:00 p.m. at the Cape Elizabeth Town Hall.

01:15:19 Item# 133-2013          Report from the Ordinance Committee Regarding Sandwich Board Signs and Open Flags
The ordinance committee is recommending draft amendments to the Sign Ordinance regarding sandwich board signs and “open flags”.  It is recommended a public hearing be set for Monday, December 9, 2013 at 7:00 p.m..
01:20:31 Item# 134-2013          Maine Department of Transportation Offer to Pave Route 77 from the Inn by the Sea to Monastery Road in 2014
MDOT has proposed a program to shim and overlay Route 77 from the Inn by the Sea to Monastery Road.  They have estimated a cost of $574,200 with a federal share of $430,650, a state share of $57,420 and a local share of $86,130 (15%).  Town staff believes this estimate is high but it is no question a great opportunity for the town. We hope that if actual costs are lower that we can persuade MDOT to extend the project towards the grange hall. The local share would come from the existing appropriation for roadways and drainage (Acct. 7154009) .  It is proposed to authorize the town manager to sign all necessary documents to complete the project and to approve the local match amount of $86,130 to be spent from account 7154009.

The Fort Williams Advisory Commission is recommending approval of a Taste of Maine event on June 29, 2014 at Fort Williams Park per the conditions set forth by the commission at their October 17, 2013 meeting.   Taste of Maine Summary

It is proposed to refer to the ordinance committee a proposal to prohibit the use of tobacco products at Fort Williams Park.   Link to Commission Recommendation

01:31:17 Item# 137-2013          Draft  Storm water Program Management Plan   
It is proposed to approve the storm water program management plan for submittal to the Maine Department of Environmental Protection.
01:28:56 Item# 138-2013          Ottawa Road Combined Sewer Overflow Plan 
The town council held a public hearing on October 7, 2013 on the plan for addressing the combined sewer overflow at the end of Ottawa Road at the municipal boundary with South Portland.  It is proposed to approve the plan. Sewer Rates  have been set in recent years with  the anticipation of the cost of implementing this plan. It is expected that sewer rates will need to continue to be adjusted each year thereafter at an amount consistent with the rate of inflation.

It is proposed to participate in a Metro Coalition study of the efficiency of fire and rescue services in the region.  The Cape Elizabeth share of the study would be $2,000 to be funded from the existing appropriation in 110 2010.   Proposal for Analysis of Fire-EMS.docx

It is proposed to enter  into executive session in conformance with 1 MRSA Sec 405 6 E to receive from legal counsel (Kenneth Cole III) an update on legal issues involving the regulation of outdoor shooting ranges.

Public Participation at Town Council Meetings
After an item has been introduced, any person wishing to address the council shall signify a desire to speak by raising their hand or by approaching the lectern.  When recognized by the chairman, the speaker shall give his or her name and address or name and local affiliation, if the affiliation is relevant, prior to making other comments.  All remarks should be addressed to the Town Council. Comments shall be limited to three minutes per person; however, the time may be extended by majority vote of councilors present. For agenda items that are not formally advertised public hearings, the time for public comments is limited to 15 minutes per agenda item. This time may be extended by a majority of the Town Council.  The chairman may decline to recognize any person who has already spoken on the same agenda item and may call on speakers in a manner so as to balance debate.  Once the Council has begun its deliberations on an item, no person shall be permitted to address the Council on such item.      
Speaking at the meeting on topics not on the agenda at regular Council meetings
Persons wishing to address the Council on an issue or concern local in nature not appearing on the agenda may do so at a regular Town Council meeting before the town manager’s report and/or after the disposition of all items appearing on the agenda. Any person wishing to address the Council shall signify a desire to speak by raising their hand or by approaching the lectern.  When recognized by the chairman, the speaker shall give his or her name and address or name and local affiliation if the local affiliation Council. Comments in each comment period shall be limited to three minutes per person and 15 minutes total; however, the time may be extended by majority vote of councilors present.
Decorum
Persons present at Council meetings shall not applaud or otherwise express approval or disapproval of any statements made or actions taken at such meeting. Persons at Council meetings may only address the Town Council after being recognized by the chairman.
