Short-cut road initiative passes
in June 13 election
Cape Elizabeth voters approved a townwide initiative to limit short-cut roads
between developments by a vote of 1,158 to 847.
Voter turnout at the June 13 special municipal and primary election was 2,034,
approximately 26 percent.
In the local race for the Republican nomination to State House from District
121, Jennifer L. Duddy defeated Michael D. Mowles Jr. 652 to 318.
Cape Elizabeth Republicans also gave gubernatorial hopeful Peter Mills their
nod to represent their party. Mills had 538 votes from Cape Republicans,
with David Emery receiving 287 votes and Chandler Woodcock receiving 198.
Cape Democrats favored incumbent Gov. John Baldacci in the primary over
challenger Christopher Miller, 592 votes to 117. In the race for the party
nomination for U.S. Senate, Cape Democrats favored Eric Mehnert over Jean
Hay Bright, 317 to 279.

Shall the proposed citizen initiated ordinance amendments to limit Short-Cuts
between Major Roads using Developed Residential Streets, a copy of
which is printed below, be adopted?

PROPOSED AMENDMENTS
ORD. SECTION 19-1-3 IS HEREBY AMENDED BY ADDING THESE DEFINITIONS:
Developed Residential Street: A local street providing vehicular access for
five (5) or more existing dwelling units, considered as of the time Immediately
prior to the proposed construction of a through road creating a short-cut
via such local street
Short-Cut: A through road that creates a shorter distance for vehicular travel
between any two points on arterial, collector, rural connector or feeder
streets. The distance along a short-cut shall be measured along the centerllne
of the traveled way incorporating such short-cut, from the centerllne of
the nearest Intersection with an arterial, collector, rural connector or
feeder street on one side of the short-cut to the centerllne of the next
nearest Intersection with an arterial, collector, rural connector or feeder
street on the other side of the short-cut. This short-cut distance shall
be compared to the distance measured along the centerllne of the shortest
existing traveled way between such same two points by any other route.
Through Road: A road with more than one point of ingress or egress from or
to the larger network of roads. A through road does not include a road approved
by the Planning Board with continuously maintained physical barriers to prevent
motorized vehicular traffic other than (i) emergency vehicles or public works
vehicles while providing services, or (ii) through traffic during a temporary
emergency traffic diversion by order of public safety authorities.
SECTION 19-7 IS HEREBY AMENDED BY ADDING A NEW SUBSECTION 19-7-16:
19-7-16. Creation of Short-Cut via Developed Residential Street
No new short-cut may be created. If the measurement of the distance along
such short-cut includes a developed residential street.
Notwithstanding the waiver provision of Sec. 16-3-5 or otherwise, the foregoing
limitation on the creation of short-cuts via developed residential streets
shall not be waived by the Planning Board in connection with any subdivision
approval.
Notwithstanding 1 M.R.S.A. B302, this provision shall apply to any pending
proceeding proposing the creation of a short-cut via a developed residential
street, unless all approvals and building permits for the project have been
obtained prior to the filing of the petition for enactment of this Ordinance
with the Town Clerk.
