Joint Town Council – Planning Board Workshop on Land Use Amendments
Tuesday, September 7, 2010, 7:00 to 9:00 p.m.

1. Welcome / Introduction – 5 minutes (Anne Swift-Kayatta and Peter Hatem)

2. Review of Land Use Section of the Comprehensive Plan (pages 139-154) – 15 minutes (David Sherman and Peter Hatem; Maureen O’Meara)

- Goals

- State Law Requirements

- Town Council memoranda to Planning Board regarding implementation

3. Growth Projections / “Expected New Growth” (pages 147-148) – 15 minutes

- Background on the projections set forth in the Comprehensive Plan (Anne Swift-Kayatta; Maureen O’Meara)

- Must we have them? Legal requirements (Peter Hatem and David Sherman)

- Review report of Planning Decisions on growth projections (Michael McGovern / Frank O’Hara of Planning Decisions)

4. Growth Areas – 10 minutes

- Background on growth areas; how they were determined (Anne Swift-Kayatta; Maureen O’Meara)

- Must we have them? Legal requirements (Peter Hatem and David Sherman)

5. Proposed Land Use Amendments – 10 minutes

- Summary (Maureen O’Meara and Peter Hatem)

6. Public Comment – 15 minutes (depending on number of attendees, this can be modified at the Council / Planning Board’s discretion)

7. Town Council and Planning Board Discussion – 40 minutes (Peter Hatem and Anne Swift-Kayatta; entire Planning Board and Council)

- Impact of revised growth projections on (i) the need for the Amendments and/or (ii) the Comprehensive Plan in general

- Is doing nothing to amend the Ordinance an option? Will that achieve goals of the Comprehensive Plan?

Ø What might our Town look like if we do not amend the Ordinance?

Ø Do we need to move forward with any amendments in light of those projections?

- Growth Areas – Should the Town Ordinance “encourage” growth within certain areas of Cape Elizabeth ?

- Can or should we amend the Ordinance to discourage (or eliminate) growth?

- Has the directive to the Planning Board changed?

- Can or should the Council revise/amend the Comprehensive Plan?

- Next steps

Planning Board Meeting Aug. 17, 2010 - canceled

The regular August 17, 2010 Planning Board meeting has been canceled due to the absence of revised materials submitted by the submission deadline.

The Planning Board will hold a joint workshop with the Town Council on Tuesday, September 7th and a regular meeting on Tuesday, September 21st.

The Cape Elizabeth Planning Board will hold a workshop on Tuesday, August 3, 2010, beginning at 7:00 p.m. in the Jordan Conference Room, Town Hall.

AGENDA

7:00 1. Poole Mill Pond Resource Protection Permit - Malcolm Poole would like to discuss a Resource Protection Permit to perform maintenance alterations to the pond located adjacent to Old Mill Rd (R2-14)

7:20 2. Review of Planning Board Rules of Procedure - The Planning will continue its review of the Rules of Procedure, including revisions requested at the last meeting.

8:00 3. Land Use Amendments Package - The Planning Board will continue development of amendments to the Zoning Ordinance recommended in the Comprehensive Plan that promote compact development and preserve open space.

7:05 Portland Water District S. Cape Pump Station Upgrade Resource Protection Permit - The Portland Water District is requesting a Resource Protection Permit for an upgrade to the Southern Cape pump station, located on Spurwink Ave, for work such as new piping, underground electrical conduit, a new utility pole and paving within the RP1 buffer, Sec. 19-8-3, Resource Protection Completeness and Public Hearing.

7:25 Evergreen Memory Care Site Plan Amendment - Lon Walters is requesting an amendment to the previously approved site plan for the facility under construction at 126 Scott Dyer Rd to change the name from Evergreen Memory Care to Cape Memory Care, Sec. 19-9, Site Plan Amendment.

7:40 Shore Road Path Site Plan/Resource Protection Permit - The Town of Cape Elizabeth is requesting Site Plan Review and a Resource Protection Permit to construct the Shore Road Path, a 2 mile long off-road path located on Shore Rd from the old entrance to Fort Williams (next to the pond) to the Town Center, Sec. 19-9, Site Plan Public Hearing, and Sec. 19-8-3, Resource Protection Permit Public Hearing.
